Darien landlords rarely look like urban apartment investors. The typical file is a single-family house leased while the owners work abroad, a Noroton Heights duplex kept in the family, a Tokeneke property rented between sales, or a new accessory dwelling unit behind the main house. Condo units appear too when the declaration allows leasing. The common thread is that coverage has to follow the deed, the occupancy and the town’s ADU rules, not a one-size landlord package.
Portsmouth Atlantic Insurance is our family’s independent agency, open since 2005. We compare 40+ carriers for Darien dwelling, liability, flood and umbrella placements and keep them aligned with the house you live in and the cars you drive. We serve Connecticut from our Connecticut office and by phone, email and online. Reach us at (603) 431-4020.
Key takeaways
- Roughly one in six Darien homes is rented, and nearly four in ten of those rentals are detached houses.
- A rented ADU usually needs an endorsement or its own dwelling policy; Darien also requires owner occupancy plus a yearly affidavit.
- Accessory units may not be used for commercial stays of 90 consecutive days or less.
- LLC, trust and estate titles must appear correctly on the policy, and the umbrella must reach the rental.
- Lost rent after a flood is outside the NFIP Dwelling Form; some private flood contracts can include it.

How large is Darien’s rental stock?
Census estimates for 2020–2024 put about 7,230 occupied homes in Darien, with about 1,270 rented—about one in six (B25003). Among those rentals, about 480 are detached houses (nearly four in ten), about 130 are in two-unit buildings, about 140 in three- or four-unit buildings, and about 480 in buildings of five units or more (B25032). Detached houses still dominate the town overall: about 6,530 of 7,680 homes (B25024).
Cash rents skew high. Of roughly 1,240 rentals reporting a cash rent, about 670 fall in the survey’s top bracket of $3,500 a month or more (B25063). About 160 additional homes are vacant for seasonal or occasional use (B25004). That combination makes fair rental value coverage a real line item, not an afterthought.
Age matters for underwriting. About 2,100 Darien homes were built in 1939 or earlier, and more than half of the stock predates 1980 (B25034). Carriers ask early about panels, heat, plumbing and lead paint.
Neighborhood patterns that shape the quote
Leased houses turn up near both Metro-North stops, along the Boston Post Road, and in Tokeneke, Noroton and the streets off Middlesex and Hoyt. Darien never developed a large apartment spine, so two- and three-family buildings are scattered. A Tokeneke estate lease and a station-area duplex are different risks even when both sit inside the same town line.
The 2022 Affordable Housing Plan traces most higher-density housing to designed-business overlays along the Post Road in the 1980s and to later age-targeted condominiums near the stations. Those condo buildings can become rentals when rules allow, but day-to-day landlord work in Darien is still mostly single-family.
Choosing the right form
Fully leased houses and condos
When nobody in the owner’s family lives on site, we place the building on a dwelling fire form. DP-1 lists named perils and often settles at actual cash value; DP-3 is broader and usually settles at replacement cost, which is why we start there. For Connecticut one- to four-unit rentals we shop Vermont Mutual, Andover, Liberty Mutual, Hanover, Providence Mutual and Foremost. Leased condo units also need a unit form that permits tenants and lines up with the master policy.
When you live in one unit
If you occupy one apartment and lease the rest, many companies will cover the entire building on a homeowners contract, which folds in your belongings and personal liability with the structure. Carriers we use for that approach include Vermont Mutual, Andover, Providence Mutual, Liberty Mutual, Hanover, Foremost, Openly, Stillwater, Cincinnati and National General. Landlord insurance vs. homeowners insurance walks through the tradeoffs.
Accessory dwelling units under Darien’s 2024 rules
Darien rejected the state’s as-of-right accessory-apartment mandate, then wrote its own ADU regulations effective June 30, 2024. Where zoning allows, one ADU may share a lot with a principal single-family house, attached or built separately. The record owner must live in one of the two units, may not keep roomers or boarders on the lot, and must file an affidavit at permit time and every year after. Size caps on the town checklist are about 700 square feet for attached units and about 1,000 for detached ones. Commercial zones and the R-NBD zone are off-limits, and the ADU cannot be sold apart from the primary residence (Darien ADU page; ADU checklist).
Even with owner occupancy, a rented ADU is easy to leave underinsured. Ordinary homeowners forms typically exclude other structures rented to people who are not tenants of the main dwelling, unless the building is only a private garage. We fix that with a rented-structures endorsement or a separate dwelling policy on the ADU, and we add liability for the tenancy. Bring the unit up before the first lease, not after the first claim.
Five units and up
At five units, personal lines end. The account becomes commercial habitational: one package for the building, lost rents, premises liability and equipment breakdown. Connecticut 5+ unit placements go to Vermont Mutual, Andover and Providence Mutual. Details sit on our Connecticut apartment building insurance page.
Vacancy, seasonal rentals and the 90-day ADU limit
Darien’s ADU checklist bans commercial short-term rentals of 90 consecutive days or less in accessory units. A conventional annual lease is a normal landlord risk. A furnished summer let of a few months puts the owner’s own contents in a tenant’s care, so schedules and inventories matter. Nightly or weekly guests look like lodging, which most homeowners and dwelling forms do not contemplate. If you will rent your own residence while traveling, ask first; carriers disagree on whether occasional rental is allowed.
Empty periods between tenants create their own traps. After about sixty days vacant, many dwelling forms drop vandalism, glass and some water coverage. Leave heat on, shut water when practical, and schedule weekly walk-throughs. Seasonal emptiness near Tokeneke and the shore is common enough that underwriters ask about it early.
LLCs, trusts and estates on Darien deeds
Plenty of Darien rentals sit in an LLC, a revocable trust or an estate. The policy has to mirror that title. Put the owning LLC on the declarations, and usually its members or manager. For trusts, the trustee is typically the named insured. Personal umbrellas often stop at personally owned real estate, so confirm whether an endorsement or a separate excess policy is needed for LLC property.
Estates add timing pressure. A house can sit empty for months during probate, and vacancy clauses on the existing policy may already have bitten. Notify the insurer promptly about the death and who now occupies the property. When tenants remain, state law treats executors, trustees and other court-appointed receivers collecting rent as landlords for deposit rules, and landlords who live outside Connecticut must appoint the Secretary of the State to accept legal papers (CGS 47a-21).
Liability limits next to a high-value primary home
Slips on ice, loose rails and dog bites drive most landlord liability claims; Darien files also involve pools, docks and long private drives. Match liability to the property, then schedule every rental on a personal umbrella. On the house you occupy, we compare Cincinnati and Chubb—both write at any dwelling limit—while each rental goes to carriers that fit that file. See Darien high-value home insurance.
Flood exposure on Darien rentals
The August 2021 Darien hazard-mitigation annex maps AE floodplains along the Noroton River, Stony Brook, the Goodwives River, Tokeneke Brook and the Five Mile River, plus VE and AE zones on the shore. It lists 55 repetitive loss properties (45 residential) and nine repetitive losses in zone X. Gorhams Pond sits in a wide floodway where Stony Brook meets the Goodwives River.
Inland flooding is easy to miss. The annex reports tidal-linked flooding on Boston Post Road and Leroy Avenue beside the Darien station. Rental houses and small multi-family buildings near the station and Post Road can take water in basements and garages even outside a mapped SFHA.
How landlords buy flood coverage
New NFIP flood policies go through Selective. Building coverage on an NFIP policy for a one- to four-family residence tops out at $250,000, and contents apply only to property the landlord owns. The Dwelling Form leaves out rental income you lose during repairs (FEMA Dwelling Form). Fresh NFIP policies usually attach after a 30-day wait. Private and excess flood markets can raise building limits and sometimes restore lost rent. Private markets we use include Flow Flood, Neptune Flood, Beyond Floods, The Flood Insurance Agency, CatCoverage and Aon Edge. Confirm the zone at the FEMA Flood Map Service Center; more town detail is on Darien flood insurance.
Local and state landlord rules
- Fair Rent Commission. Public Act 25-1, passed in a 2025 special session, lowered the population threshold for a required fair rent commission from 25,000 to 15,000, counted in the most recent federal census. Darien had about 21,500 residents in the 2020 Census, so the town must now create a commission or join a joint or regional one by January 1, 2028 (OLR public act summary). Statewide tenant-protection statutes still apply.
- Habitability. Under CGS 47a-7, owners must follow building and housing codes, keep the unit fit to occupy, keep shared spaces safe, maintain heat, plumbing and electrical systems, and provide running water plus reasonable heat.
- Security deposits. State law caps deposits at two months of rent, or one month after a tenant reaches age 62. Funds sit in a Connecticut escrow account and must come back with interest no later than 21 days after the tenancy ends, or 15 days after you receive a forwarding address, whichever date is later (CGS 47a-21).
- ADU short-term ban. Accessory units may not serve as commercial short-term rentals of 90 consecutive days or less (ADU checklist).
- Lead paint. Pre-1978 housing may contain lead; many landlord forms limit or exclude lead claims. Ask each carrier how it handles lead and keep inspection records.
A code-driven rent reduction is not an insured loss. Fair rental value pays only after covered physical damage.
Underwriting questions we expect
- Title and who lives there. Deed holder, on-site owner or family, lease length, seasonal or short-term use.
- Building systems. Roof, electrical service and panel, heat type and age, water heaters, supply lines.
- ADU details. Zoning approval, separate entrance and parking, affidavit status, alarms.
- Extras. Pools, docks, hot tubs, trampolines and how guests reach them.
- Water history. Flood zone, elevation certificate, below-grade space, sump pumps, prior water claims.
- Empty periods. How long units sit vacant and who inspects them.
What a Darien landlord file usually includes
Beyond the address and deed, underwriters want update years for the roof and major systems, photos of the electrical panel, heat type, any known prior water losses, and a clear statement of who lives on site. For ADUs we also need the zoning approval, parking layout and proof that the annual owner-occupancy affidavit is current. If the property sits near the Post Road, the station or a mapped floodplain, an elevation certificate or prior flood-zone determination helps us compare NFIP and private flood side by side.
Lease terms matter too. A one-year family lease is underwritten differently from a corporate temporary housing arrangement or a furnished sublet. Tell us about pets, trampolines, pools and dock access up front so liability and umbrella limits are not guessed after binding.
Why Darien landlords use an independent agency
A Tokeneke lease, a station duplex, a backyard ADU and an LLC condo seldom fit one carrier. We place each risk where it belongs, keep named insureds honest and hang one umbrella over the set.

Frequently asked questions
Which form should cover a Darien house I lease out?
Most fully leased houses and condos go on a dwelling fire policy. We usually prefer the open-perils DP-3, with fair rental value and premises liability included. If you live in one unit of a two- to four-family, some carriers will instead write the whole building on a homeowners form.
Does my homeowners policy protect a rented Darien ADU?
Usually not without help. Typical homeowners forms leave out other structures that are rented to someone who is not also a tenant of the main house, except when the structure is only a private garage. We add an endorsement for structures rented to others, or place a separate dwelling policy on the ADU. Darien also requires the record owner to live in the main house or the ADU and to renew an affidavit every year.
Are short stays allowed in a Darien accessory unit?
Town rules forbid using an ADU as a commercial short-term rental of 90 consecutive days or less. Longer leases may be fine under zoning, but insurance still has to match the use. Tell us before you advertise a stay so we can find a form written for that occupancy.
The deed is in an LLC. How should the policy read?
List the LLC that owns the property as a named insured, and usually list you as a member or manager too. If the deed and the policy disagree, claims get harder. Confirm that your umbrella actually reaches LLC-owned real estate; many personal umbrellas need an endorsement for that.
Will NFIP flood insurance replace rent I lose after a flood?
It will not. The NFIP Dwelling Form omits loss of rental income. Some private flood contracts can add that option, and we compare those when the rent matters to the owner.
Is there a Darien Fair Rent Commission?
Darien is now required to have one. A 2025 state law, Public Act 25-1, requires every municipality with at least 15,000 residents to create or join a fair rent commission by January 1, 2028, and Darien had about 21,500 residents in the 2020 Census. Habitability duties and security-deposit rules under state law still apply. Insurance does not pay for a rent reduction ordered by a commission.
What information do you need for a Darien rental quote?
Address, how title is held, unit count, year built, roof/electrical/heat/plumbing update years, whether an owner or family member lives on site, lease length, and five years of claims history. Call (603) 431-4020 or use the form on this page. Request a quote. There’s no obligation to buy.
